THE SOULTY SURFER – TERMS AND CONDITIONS

A welcoming, inclusive space for movement, nature, community and wellbeing.

By attending any class, course, event, workshop, retreat, sea dip, sauna session, or activity with The Soulty Surfer, you agree to the following Terms & Conditions. These policies are here to ensure safety, clarity, and a positive experience for all.

1. Our Community Values + Code of Conduct

The Soulty Surfer is a welcoming and inclusive community. Every participant deserves to feel safe, respected and supported.  By joining any session, you agree to:

Respect & Inclusion

  • Treat all students with kindness and respect, regardless of background, identity, or experience level.

  • Use considerate and non-discriminatory language.

  • Maintain a calm, supportive environment and allow others to practise without interruption.

Teacher Boundaries

To ensure a safe atmosphere for everyone:

  • The teacher may ask a student to leave, or decline future attendance, if behaviour is unsafe, disruptive, boundary-crossing, or makes others uncomfortable.

  • Aggression, intimidation, harassment or inappropriate behaviour are not tolerated.

  • The teacher may refuse service, without explanation.

Privacy & Confidentiality

  • Respect others’ personal information and experiences.

  • Do not share images, videos, or conversations from classes or events without explicit consent.

  • Filming or audio recording is not permitted unless agreed with Dani.

 

2. Booking + Attendance Policy

Clear and consistent booking helps protect your safety, manage numbers, and maintain smooth running classes.

Booking Requirements

  • All classes must be booked in advance through the booking system.

  • A class pass does not secure a space until a booking is completed through the system using your pass code.

  • You may be refused entry if you arrive without a confirmed booking.

Communication Channels

To keep admin manageable for a small business:

  • All class enquiries, updates and communication must be via WhatsApp or email.

  • SMS, social media DMs, and other platforms are not used for class admin (though casual chat may happen here).

  • Bookings are only accepted through the official booking system.

Arriving to Class

  • Please arrive on time and be ready to begin.

  • Late arrivals may not be admitted for safety reasons.

3. Safety, Medical Responsibility + Participation

Your wellbeing is the priority, and participation is always at your own risk.

General Participation

  • You are responsible for listening to your body and practising within your own limits. Never force or strain.

  • If you feel unwell, dizzy, light-headed or in pain, stop immediately.

  • You are encouraged (but not required) to inform the teacher of injuries, pregnancy, medical conditions, or concerns that may affect your practice.

Outdoor Sessions

Including beach yoga, forest sessions, coastal walks and outdoor movement:

  • Terrain may be uneven, sandy, slippery or affected by weather.

  • You are responsible for appropriate clothing, footwear, hydration and sun protection.

  • Sessions may be adapted or cancelled for safety reasons due to weather or environmental conditions.

4. Cold Water, Sea Dips + Ice Bath Activities

These sessions include inherent risks and require heightened self-awareness.

By taking part in cold water experiences, you understand and accept:

  • Cold water carries risks of cold shock, hypothermia, dizziness, panic response, and rapid heart-rate changes.

  • You must monitor your own limits and exit the water immediately if you feel unwell.

  • Certain medical conditions (especially heart issues, respiratory conditions, circulatory concerns or pregnancy) may increase risk.

  • Participation is entirely at your own discretion and responsibility.

The teacher may ask you not to enter the water or to exit early if it appears unsafe.

5. Sauna, Heat Exposure + Hot/Cold Contrast

For sauna sessions:

  • Heat exposure may not be suitable for individuals with heart conditions, high/low blood pressure, pregnancy, respiratory conditions or certain medications.

  • You are responsible for monitoring your own tolerance and staying hydrated.

  • The teacher or sauna operator may limit time in the heat if necessary for safety.

  • If you feel faint, anxious, dizzy or unwell, exit immediately.

6. Class Passes

The Soulty Surfer offers class passes of various types.
By purchasing a pass, you agree that:

  • A pass does not reserve a spot until a booking is made through the system.

  • Pass validity periods vary depending on the offering.

  • Passes may be extended for illness, injury, or extenuating circumstances at Dani’s discretion.

  • Passes are non-refundable once activated, except as required by law.

7. Cancellation, Refunds + Transfers

Regular Classes

  • Cancellations must be made 48 hours before the class start time to avoid losing the session.

  • No shows or late cancellations are non-refundable.

Workshops, Events & Retreats

  • These are non-refundable as spaces are limited and costs are committed in advance.

  • If you can no longer attend, Dani may attempt to resell your space. If successful, a refund may be offered at her discretion.

  • Retreat deposits and payments are non-refundable.

  • If you need to cancel, Dani will attempt to resell the space. Refunds are discretionary and depend on the circumstances and timing.

  • Exceptional circumstances may be considered on a case by case basis.

8. Right to Refuse Service + Removal from Sessions

To maintain a safe, inclusive environment:

  • The teacher reserves the right to refuse entry or remove a participant from any class, event or retreat without explanation.

  • Reasons may include (but are not limited to):

    • unsafe or disruptive behaviour

    • boundary crossing

    • inappropriate or intimidating conduct

    • attending under the influence of drugs or alcohol

    • failure to use the booking system

    • behaviour that makes the teacher or other students uncomfortable

  • Where appropriate, unused bookings may be refunded at Dani’s discretion.

9. Drugs + Alcohol Policy

  • All classes, events and retreats are alcohol and drug free spaces.

  • Students may not attend under the influence of drugs or alcohol.

  • If this is suspected, the teacher may request that the student leave immediately.

10. Website Usage + Liability

The website content is for educational purposes only.
Participation in any The Soulty Surfer activities is entirely at your own risk.

The Soulty Surfer accepts no liability for:

  • injuries sustained during classes or events,

  • loss or damage to personal belongings,

  • risks associated with outdoor environments,

  • adverse reactions to cold water, heat, or contrast therapy,

  • or any impacts arising from your use of this website or your participation in activities.

Always seek medical advice before undertaking new physical practices if you have health concerns.

11. Agreement to Terms

By attending any The Soulty Surfer class, event, session, sea dip, sauna, workshop or retreat, you confirm that:

  • You have read, understood and agree to these Terms & Conditions.

  • You accept responsibility for your own wellbeing and safety.

  • You understand that boundaries and booking procedures are essential to maintaining a safe and supportive space.
